Purpose and scope:
These general terms and conditions of sale (GTC) form the basis of commercial negotiation and are systematically sent or given to each buyer to enable them to make their reservation.
The general terms and conditions of sale described below detail the rights and obligations of the company Terre et Source Provence SAS and its client in the context of the tourist booking of one of the gîtes put into operation by the company Terre et Source Provence SAS.
Any acceptance of the reservation, including the clause "I acknowledge having read and I accept the general terms and conditions of sale attached hereto", implies the buyer's unreserved acceptance of these general terms and conditions of sale.
Price :
The rental prices for the furnished tourist accommodation are those in effect on the day of the client's arrival. They are quoted in euros, and the tourist tax is calculated at the time of booking. Consequently, they will be increased by the applicable VAT rate and transportation costs on the date of the order.
Terre et Source Provence SAS reserves the right to modify its prices at any time. However, it undertakes to charge for reservations at the price indicated at the time of booking.
Discount:
No discount will be given for early payment.
Payment methods:
Payment for tourist reservations is made:
- either by bank card; ;
- either by bank transfer to the account opened in the company's name
Payments will be made under the following conditions:
Full payment is required at the time of booking and the booking will be effective upon receipt of full payment.
Cancellation and refund conditions:
- If the cancellation takes place more than 80 days before the booking date, a full refund will be given.
- If the cancellation takes place between 80 and 60 days before the booking date, a refund of 50 % will be issued.
- If the cancellation takes place less than 60 days before the booking date, no refund will be given.
Force majeure:
Terre et Source Provence SAS shall not be held liable for any failure to perform or delay in performing any of its obligations under these terms and conditions of sale if such failure or delay is due to force majeure. For the purposes of this clause, force majeure shall mean any external, unforeseeable, and irresistible event as defined in Article 1148 of the French Civil Code.
Competent court:
Any dispute relating to the interpretation and execution of these general terms and conditions of sale shall be subject to French law.
In the absence of an amicable resolution, the dispute will be brought before the Commercial Court of Draguignan.
